Booking Terms & Conditions
By making a booking with Oyasin Ltd. LLC (hereinafter called “Oyasin”), you accept these Terms & Conditions. A booking is accepted and becomes definite once you (the “Participant”) make a payment and we send you a confirmation email. Even after this initial confirmation, there may be changes to your booking. Oyasin reserves the right to change or update these Terms & Conditions at any time and without advance notice.
Pricing
All retreat prices are quoted and payable in EUR. Oyasin is not responsible for any fees incurred due to currency exchange or fees charged by your credit card/bank for processing funds in another currency.
Cancellation / rescheduling by Oyasin
Oyasin reserves the right to cancel or reschedule any retreat for any reason. We do our best not to cancel a retreat less than 30 days before departure except for Force Majeure, natural disasters, pandemic, travel bans, war, civil unrest or other unusual or unforeseen circumstances outside the Oyasin’s control.
When a retreat is canceled by Oyasin before the agreed date of departure for any reason, you have two options:
Option 1. Transfer your retreat payment (less any non-refundable costs already paid to suppliers) to the same Oyasin retreat in the future, or to a different Oyasin retreat. Tell us which retreat you choose and we will apply all remaining funds to your new booking.
Option 2. Request a refund. We will refund you less any credit card processing fees, cancellation fees, and nonrefundable deposits we paid to local suppliers on your behalf.
Note: If you purchased travel insurance, you can file a claim with your travel insurance provider for reimbursement of the non-refundable portion of your retreat payment. We can provide you with a receipt and notice of cancellation for this insurance claim.
To cancel your retreat, please reach out to us at: aho@oyasin.co. Please do not request a chargeback from your credit card company. We will work with you to process your refund in a timely manner.
Oyasin is not responsible for any incidental expenses or consequential losses that the Participant may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. If the Participant is offered a refund but requests an alternate retreat of a higher value than that originally booked, then the Participant must pay the difference in price.

Non-refundable booking
Oyasin Retreat bookings made by the Participant are non-refundable.
Medical Screening refund
In case the Medical Screening by Oyasin indicates that the Participant is not fit to partake in the retreat after booking, the Participant will be fully refunded for the retreat fee.
Airfare and transfer
Oyasin retreats do not include national or international airfare, or transfer to the retreat center. You are responsible for your airfare and are responsible for any non-refundable expenses you incur in the event we cancel a retreat. We highly recommend you purchase travel insurance for all your travel expenses.

Insurance
Oyasin highly recommends Participants to obtain travel medical insurance with a minimum medical coverage of EUR 100,000. This insurance must cover personal injury and emergency medical expenses including, but not limited to, helicopter evacuation, air ambulance and repatriation. It is strongly recommended the coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience that may occur during travel.
Oyasin also recommends obtaining a Diving Insurance.
Force Majeure
Oyasin assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Oyasin that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by Oyasin. Our planning fee is always non-refundable.

Medical conditions
You must notify us in the Oyasin Screening Form, in the Freediving Medical Form about any medical conditions, pregnancy, disability or any other mental and or physical condition which may affect your participation in the retreat. This includes any symptoms of Covid-19 or our suspected exposure to the virus that causes Covid-19. Failure to notify us of such a medical condition may result in your being refused travel, in which case the client is bound by the cancellation terms as laid out here.
Some Retreat Activities (such as ceremonies and freediving) may be unsuitable for you due to age, mobility, disability, pregnancy or physical or mental conditions. It is your responsibility to clear major medical issues with your doctor and with the Oyasin team prior to booking. The Participant has complete freedom to decide to not partake in a Retreat Activity, if the Participant feels that it is in his or her best interest to not partake. Similarly, if the Oyasin Retreat Leader feels that it is in the Participant’s best interest to not partake in a Retreat Activity, the Oyasin Retreat Leader has the right to refuse the Participant’s participation. In the case that the Participant refuses to partake in a Retreat Activity, or Oyasin refuses the Participant to partake, no refund is granted to the Participant. Medical facilities vary from country to country and Oyasin makes no representations and gives no warranties in relation to the standard of such treatment.

Evacuation costs
Evacuation costs are to be covered by the person being evacuated. You may file a claim with your travel insurance company to try to recoup any additional costs related to injury or illness treatment or travel.

Required travel documents
You must have a valid passport required for entry, departure and travel to Mexico (passport must be valid 6 months past the return date), all visas, permits and certificates including vaccination certificates (if required), insurance policies, etc. are required for the whole of the journey. The Participant accepts full responsibility for obtaining all such documents, visas and permits prior to the start of the retreat and is solely responsible for any adverse consequences resulting from missing or defective documentation. Any information or advice given by Oyasin regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the Participant and Oyasin is not responsible for any errors or omissions as to the information provided by third parties such as the appropriate governmental authorities.
If other documentation is required by the country, state or county (such as proof of vaccination, health declaration, affidavit, Covid-19 test results, etc), we do our best to relay that information to you during the trip planning period. However, it is ultimately your responsibility to have all the required documents completed prior to departure.
Retreat itinerary changes
Oyasin reserves the right to alter retreat programs due to weather, road conditions, local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, natural disasters and other unforeseeable factors. This includes changes or cancellation of planned runs and any other aspect of the retreat itinerary to ensure the safety of our clients and staff. We accept no responsibility for losses, expenses due to delays, changes of flights or other services because of strikes, accidents, sickness, damage, negligence, weather, war, natural disasters, changes in schedules or other similar causes. Oyasin do not assume responsibility for accidents or deaths that can be traced to the participants’ negligence, acts of third parties or exterior circumstances.

Safety
Your safety and well-being are our highest priority, which is why we include a physical and mental health screening, and work with the best medicine guides and partners. However, you are ultimately responsible for your safety, which is why we ask all retreat participants to sign a liability waiver at the start of the retreat. To avoid possibly dangerous situations, it is extremely important that you obey any rules and regulations imposed by the Oyasin Retreat Leaders and instructions given by them.
Oyasin reserves the right to prohibit any Participant from continuing a retreat, with no right of refund if, in our opinion, that Participant’s actions pose a threat to their own safety or that of others, or seriously jeopardizes the enjoyment of the other participants. The decision of the Oyasin Retreat Leader or representative will at all times be final on all matters likely to affect the safety and well-being of the retreat participants.
Removal from a retreat
Participating in a retreat is a shared responsibility. If you are asked to leave a retreat for bad behavior, violence, or any other disruptive action, you will not be refunded or reimbursed.
The Participant will undergo a Health Screening by Oyasin. The Participant confirms that all information provided by the Participant is true. If it turns out that you have undisclosed physical health issues, mental health challenges, addictions including alcoholism or substance abuse that makes you a danger to yourself or others on your retreat, you will be asked to leave without being refunded or reimbursed.
Photography
In the course of participation in a retreat, photos and videos are taken by a photographer. These images may be used in any Oyasin materials, website, social media, etc., unless you specifically request that we not use any material in which your image is depicted in the Video Consent Form that we share at the start of the retreat. Otherwise, you agree to allow us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
Indemnification
Each Participant is expected to act responsibly and adhere to all behavior guidelines established by Oyasin. Our team reserves the right to remove you from any retreat if you endanger yourself or others or disrupt others. In any such case, there will be no refund.
Participant agrees to and shall indemnify and hold harmless Oyasin, and its employees, shareholders, agents, and representatives (collectively “Oyasin”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by Oyasin (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) Participant's breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by Participant while participating in the retreat.
